7. Your Privacy Choices

Opting Out of Sale or Sharing

You may opt out of disclosures that constitute the sale or sharing of personal information or the use of personal information for targeted advertising by selecting the “Your Privacy Choices” link in the footer of our website and following the instructions provided.

Your request will ordinarily apply to the browser and device from which you submit it. You may need to repeat your selection when using another browser or device or after clearing cookies.

When legally required, we process recognized browser-based opt-out preference signals, such as Global Privacy Control, as a request to opt out of the sale or sharing of personal information for the browser or device sending the signal.

When we can reasonably associate the signal with a customer account, we may apply the request to the account. Otherwise, it will apply to the browser or device used to send the signal.

We will not require you to create an account to exercise an opt-out right.

Cookie Controls

Our cookie-management tool allows you to control certain analytics and advertising technologies.

Strictly necessary technologies cannot always be disabled because they are needed to operate the website, maintain security, process transactions, remember privacy choices, or provide requested functionality.

Your browser settings may also allow you to block or delete cookies. Blocking certain cookies may prevent portions of the Services from functioning properly.

Email Marketing

You may unsubscribe from promotional emails by selecting the unsubscribe link in a promotional email.

We may continue sending non-promotional communications concerning orders, accounts, security, rewards, or our ongoing business relationship.

Text-Message Marketing

You may opt out of promotional text messages by replying “STOP” to a message. You may request assistance by replying “HELP.”

Consent to receive promotional text messages is not required as a condition of making a purchase. Message and data rates may apply, and message frequency may vary.

8. California Privacy Rights

Subject to applicable exceptions and verification requirements, California residents may have the rights described below.

Right to Know

You may request that we disclose the categories of personal information we collected about you, the categories of sources from which it was collected, the business or commercial purposes for collecting, selling, or sharing it, the categories of third parties to which we disclosed it, the categories of personal information sold, shared, or disclosed for a business purpose, and the specific pieces of personal information we collected about you.

For personal information collected on or after January 1, 2022, a request may cover more than the preceding 12 months unless providing the information would be impossible, involve disproportionate effort, or another legal exception applies.

Right to Delete

You may request deletion of personal information we collected from you, subject to applicable exceptions.

We may retain information needed to complete transactions, fulfill warranties, detect or prevent fraud, maintain security, comply with legal, tax, accounting, or regulatory obligations, exercise or defend legal claims, or carry out certain internal uses permitted by law.

Right to Correct

You may request correction of inaccurate personal information that we maintain about you.

Right to Opt Out of Sale or Sharing

You may direct us not to sell or share your personal information. Instructions for exercising this right appear in the Your Privacy Choices section of this Privacy Policy.

Right to Limit Certain Uses of Sensitive Personal Information

California law provides a right to limit certain uses or disclosures of sensitive personal information. We do not use or disclose sensitive personal information for purposes that currently require us to provide this right.

Right to Data Portability

When applicable, you may request that specific personal information be provided in a portable and, to the extent technically feasible, readily usable format.

Right to Non-Discrimination

We will not discriminate against you for exercising a privacy right.

Solely because you exercise a privacy right, we will not deny you goods or services, charge you a different price or rate, provide you with a different level or quality of service, retaliate against you, or suggest that you will receive a different price or level of service.

This does not prevent us from offering a lawful loyalty program or financial incentive that is reasonably related to the value of the participating consumer’s data.

9. How to Submit a Privacy Request

You may submit a request to know, access, delete, or correct personal information by emailing service@ediscountperfumes.com or calling (510) 473-7386.

Please state that you are submitting a “Privacy Rights Request” and describe the right you wish to exercise.

You may exercise your opt-out rights through the “Your Privacy Choices” link in the website footer.

Verification

We will verify requests in a manner appropriate to the nature of the request and the sensitivity of the information involved.

We may ask you to confirm information associated with your account, order, or prior interactions with us.

We will use information submitted for verification only to verify the request and prevent fraud. We will not require you to create an account to submit a request.

We may be unable to fulfill a request if we cannot reasonably verify your identity or authority or if an applicable legal exception applies.

Authorized Agents

You may designate an authorized agent to submit a request on your behalf.

We may require proof that you gave the agent signed permission to act for you, verification of your identity directly with us, and confirmation that you authorized the request.

These requirements may not apply when the agent holds a valid power of attorney under applicable law.

Response Timing

We will confirm receipt of qualifying requests and respond within the periods required by applicable law.

When reasonably necessary, we may extend the response period and will explain the reason for the extension.

We generally do not charge a fee to process privacy requests. We may charge a reasonable fee or decline to act when permitted by law if a request is manifestly unfounded, excessive, or repetitive.

10. EDP Rewards and Notice of Financial Incentive

EDP Rewards is a voluntary loyalty program through which eligible members may receive points, discounts, offers, benefits, or other rewards.

When you participate in EDP Rewards, we may collect and use your name, email address, telephone number when provided, account information, purchase and return history, rewards points, redemption activity, product interactions, preferences, and other information described when you enroll or participate.

We use this information to operate and improve EDP Rewards, administer points and benefits, communicate with members, personalize offers, analyze program performance, prevent fraud, and carry out the other purposes described in this Privacy Policy.

Current earning and redemption rules, expiration terms, exclusions, and other material program terms are provided in the EDP Rewards terms presented during enrollment or through your account.

You may enroll through the enrollment process available on eDiscountPerfumes.com. Enrollment is voluntary and requires affirmative acceptance of the applicable program terms.

You may withdraw from EDP Rewards by contacting us at service@ediscountperfumes.com. Withdrawal may result in the loss of unused points, rewards, offers, or other benefits, as described in the applicable program terms.

You may exercise applicable privacy rights without necessarily withdrawing from the program. Some information may be necessary to administer your membership, points, and rewards.

The benefits offered through EDP Rewards may constitute a financial incentive under California law.

We estimate the value of member information based on a reasonable, good-faith analysis of the incremental revenue reasonably attributable to member participation, the value of repeat purchases and member engagement, the costs of providing points and discounts, the cost of administering and maintaining the program, the cost of acquiring and retaining participating customers, and other valuation factors permitted by applicable law.

The value of an individual member’s information varies based on the member’s purchases, participation, benefits earned, and benefits redeemed.

We believe the value of EDP Rewards benefits is reasonably related to the value of the information provided by participating members.

11. Cookies and Similar Technologies

We and our service providers and business partners use cookies and similar technologies for strictly necessary, functional, analytics, and advertising purposes.

Strictly necessary technologies are used to operate the website, maintain website and account security, process orders and payments, remember shopping-cart contents, maintain logged-in sessions, prevent fraud, record privacy choices, and provide requested website functionality.

Functional technologies are used to remember preferences and provide enhanced features such as customer-service tools, personalization, and saved settings.

Analytics technologies help us understand website traffic, visitor interactions, product performance, errors, and opportunities to improve the Services.

Advertising technologies may be used to measure advertising effectiveness, attribute visits or purchases to advertising, create advertising audiences, limit repetitive advertisements, and display advertisements based on interests or activity across different websites or services.

Advertising-cookie activity may constitute sharing for cross-context behavioral advertising under California law. You may control this activity through the “Your Privacy Choices” link.

12. Analytics, Interaction, and Session Technologies

We may use analytics or website-interaction technologies to understand how visitors navigate and use the Services.

Depending on the tool and its configuration, these technologies may collect clicks, scrolling, navigation paths, device information, page interactions, and technical events.

We configure these technologies to mask or exclude passwords, complete payment-card information, and other sensitive form fields where reasonably possible.

These tools are not intended to collect the contents of payment fields or account passwords.

Where required, nonessential analytics or interaction technologies will be subject to applicable consent and opt-out controls.

13. Abandoned Shopping Carts

When you provide an email address or telephone number and begin but do not complete a purchase, we may use information about your cart and contact information to send a reminder, subject to applicable law and your communication preferences.

An abandoned-cart reminder does not mean that you are required to complete the purchase.

Promotional text messages will be sent only when we have the consent required by applicable law.

14. Data Retention

We retain personal information only for as long as reasonably necessary and proportionate to the purposes described in this Privacy Policy, unless a longer period is required or permitted by law.

Order, payment, return, tax, and accounting records are generally retained for the transaction period and for up to seven years afterward. We may retain them longer when required for tax, accounting, dispute, fraud-prevention, or legal purposes.

Customer-account information is retained while the account remains active and generally for up to three years after account closure or prolonged inactivity, subject to legal and operational needs.

EDP Rewards records are retained during membership and generally for up to three years after withdrawal or account closure. We may retain them longer when necessary for accounting, disputes, fraud prevention, or legal compliance.

Customer-service communications are generally retained for up to three years after resolution. We may retain them longer when connected to a transaction, dispute, legal obligation, or potential legal claim.

Marketing contact information is retained while you remain subscribed. We may retain suppression records after an opt-out so that we can continue honoring your request.

Website, cookie, analytics, and device information is generally retained for up to 24 months, depending on the applicable technology, purpose, and vendor configuration.

Fraud, security, and risk information is retained for as long as reasonably necessary to identify, investigate, and prevent fraud or security incidents. When the information is connected to a transaction or investigation, it may generally be retained for up to seven years.

Privacy-request records are generally retained for at least 24 months or for the period required by applicable law.

Legal claims and compliance records may be retained for the applicable limitation period and for any additional period required by law.

We may retain information longer when needed to comply with law, respond to legal process, enforce agreements, resolve disputes, prevent fraud, or protect the rights and safety of customers and others.

When information is no longer reasonably necessary, we may delete, destroy, deidentify, or aggregate it.

15. Deidentified and Aggregated Information

We may create and use deidentified or aggregated information for lawful purposes.

When we maintain information as deidentified information, we take reasonable measures to ensure that it cannot be associated with an individual or household.

We publicly commit to maintaining and using such information in deidentified form.

We will not attempt to reidentify deidentified information except as permitted by law to evaluate whether our deidentification processes are effective.

16. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

No website, transmission, or storage system is completely secure. We therefore cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of account credentials and should notify us if you believe your account has been compromised.

17. Children’s Privacy

The Services are intended for adults and are not directed to children under 16.

We do not knowingly collect personal information directly from children under 16. We also do not knowingly sell or share the personal information of children under 16.

If you believe a child under 16 has provided personal information to us, please contact us so that we can investigate and take appropriate action.

Participation in EDP Rewards is limited to individuals who meet the minimum age stated in the applicable program terms.

18. Third-Party Websites and Services

The Services may contain links to third-party websites, applications, payment services, social-media platforms, or other services.

We do not control and are not responsible for the privacy, security, or content of third-party services.

Information you provide directly to a third party is governed by that party’s privacy policy.

19. Do Not Track

Some browsers transmit “Do Not Track” signals.

Because no uniform industry standard governs all Do Not Track signals, we do not currently respond to those signals.

Do Not Track is different from Global Privacy Control. We process legally recognized opt-out preference signals, including Global Privacy Control, as described in the Your Privacy Choices section of this Privacy Policy.

20. California Shine the Light Law

California Civil Code Section 1798.83 allows certain California residents to request information concerning specified disclosures of personal information to third parties for those third parties’ own direct-marketing purposes.

To submit such a request, contact us using the information in the Contact Us section and include “California Shine the Light Request” in the subject line or written request.

21. Nevada Privacy Rights

Nevada residents may have the right to direct us not to make certain sales of covered information as defined by Nevada law.

We do not currently sell covered information in exchange for monetary consideration within the meaning of Nevada law.

Nevada residents may nevertheless contact us at service@ediscountperfumes.com regarding Nevada privacy rights.

22. International Visitors

The Services are operated in the United States and are primarily intended for customers in the United States.

If you access the Services from another country, your personal information may be transferred to, stored in, and processed in the United States or other countries whose laws may differ from those where you reside.

We do not represent through this Privacy Policy that the Services are directed to or actively offered in every jurisdiction outside the United States.

23. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our practices, technologies, Services, or legal obligations.

When we make changes, we will update the Last Updated date.

When required by law, we will provide additional notice or obtain consent before applying material changes.

We review this Privacy Policy at least annually.
